1. PREAMBLE
 

The purpose of these general conditions (hereinafter the "General Conditions") is to define the terms and conditions under which  Place Voltaire Getaway  allows its customers (hereinafter the "Customer(s)") to benefit from all the services, in particular reservations, available on this Site and described in more detail below (hereinafter together the " Services ").

 

Prior to any reservation of a Service on the Site, the Customer declares (i) that he is acting for personal purposes which do not fall within the scope of his commercial, industrial, craft, liberal or agricultural activity and (ii) have full legal capacity allowing him to engage under these General Conditions

The Customer is invited to carefully read these General Conditions, the prior acceptance of which is mandatory for the reservation of any Service offered on the Site. It is advisable for all Customers to save and print these General Conditions using the standard functionalities of their browser and computer.

The Escapade Place Voltaire reserves the right to modify or supplement, at any time, all or part of these General Conditions. In this case, the new version of the General Conditions will be available on the Site with its date of entry into force. Customers are advised to regularly consult the General Conditions to be aware of any possible modifications. In any case, the Customer will only be bound by the only version of the General Conditions in force at the time the Customer makes the reservation of his Service.

The Customer alone is required to pay, where applicable, all the technical means giving him access to the Site.

2. DESCRIPTION OF SERVICES
 

2.1 SERVICES  Place Voltaire Getaway

L'Escapade Place Voltaire offers services on its Site for booking guest rooms or other types of accommodation ("Accommodation Services") (2.1.1) and (ii) additional services to said Services ("Additional Services ”) (2.1.2).

The Accommodation Services and the Additional Services are hereinafter collectively referred to as “L'Escapade Place Voltaire”.

2.2.1 ACCOMMODATION SERVICES

The Site allows the reservation of rooms in the house, the gîte or the activity rooms operated under the L'Escapade Place Voltaire brand.  (hereinafter together the “Establishment”).

The essential characteristics, the dates of availability, the price, the options offered, the payment conditions and the special conditions of sale applicable to the selected rate (guarantee policies, cancellation conditions, check-in time, member rate conditions, etc.)  Proposed establishments are presented during the reservation process as described in article 3 below.
 

In this respect, it is specified that Establishment has its own special conditions of sale applicable to the selected rate also available on the Site (hereinafter the "Special Conditions") which are brought to the attention of the Customer before any reservation on the Site. . Thus, by way of example, the Special Conditions may detail the check-in and check-out times, the guarantee policy, the cancellation period, WiFi access, the specific conditions applicable to children, the admissibility of animals as long as they are kept on a leash or in a cage in the common areas of the establishment.
 

Finally, depending on the desired reservation method, the customer may be asked to complete a deposit form and a security deposit when entering the premises. To do this, the Customer will be asked to present an identity document.
 

3. RESERVATION PROCESS
 

The Customer chooses any Service presented on the Site by following the path provided for this purpose. He must choose his room then send an email or via the contact form to continue the reservation outside the site. 


4. PRICE AND PAYMENT


4.1 PRICES


The prices relating to the reservation of the Services are indicated before, during and after the reservation.
 

For Accommodation Services, the prices indicated are per room for the number of person(s) and the date selected.

When confirming the reservation of a Service, the total price is indicated to the Customer in an amount including tax in the commercial currency of the Establishment and is only valid for the duration indicated on the Site.

If the debit of the total price of the reservation of the Service is made at the Establishment in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the Customer. It should be noted that if a conversion of the currency confirmed on the reservation into another currency appears on the Site, it is given purely for information and not contractual, taking into account in particular the possible evolution of the exchange rates between the date of reservation and the dates of stay at the Establishment.

Unless otherwise stated on the Site, options (for example, half board, full board etc.) that are not offered at the time of booking the Service are not included in the price.

The tourist tax, presented during the Service reservation process, is to be paid directly on site to the Establishment, when the total payment for the room is made.

The prices take into account the VAT applicable on the day of the reservation and any change in the rate applicable to the VAT will be automatically passed on to the price indicated on the date of invoicing.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the price indicated on the date of invoicing.

Finally, certain promotional offers are only available on the Site and are sold exclusively on the Internet and in no case at the reception of the Establishment.

4.2 PAYMENT

The Customer must pay a deposit as a guarantee of the reservation. The total amount will be paid on the day of arrival in cash or bank transfer.

  The Establishment may also ask him to present an identity document for the purposes of preventing credit card fraud.

 

In the event of a "no show" for a reservation of an Accommodation Service guaranteed by credit card, the Establishment will ask the customer, as a lump sum, for the amount of the first night and any additional nights of the reservation will be canceled free of charge, unless otherwise indicated in the Special Conditions.

At the time of prepayment, the amount to be paid when booking the Service includes the total amount indicated at the time of booking (including all applicable taxes) and, where applicable, the price of the options selected by the Customer, such as described in section 4.1 above.


 

5. CANCELLATION OR MODIFICATION OF THE RESERVATION OF A SERVICE

For Accommodation Services (reservation of rooms within an Establishment or other types of accommodation), the Customer is reminded that he does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code, in accordance with Article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to the provision of hosting services which must be provided on a date or on a determined period.

For each Service reservation, the Special Conditions specify the terms and conditions for canceling and/or modifying the reservation.
 

Reservations with prepayment cannot be modified and/or canceled. The deposit (amounts paid in advance) will not be refunded. In this case, it is mentioned in the Special Conditions.

When the Special Conditions allow it:

 

• the cancellation of the reservation (meal) must be made 48 hours in advance by e-mail or by telephone.

• The modification of the reservation of a Service can be made directly with the Establishment, whose contact details, in particular by telephone, are specified on the confirmation of the reservation sent by e-mail.
 

In the event of interruption of a Service by the Customer, the full agreed price will be collected. In the case of reservation with prepayment before the stay, no refund will be granted.

In the presence of an Accommodation Service, unless expressly stipulated otherwise in the Special Conditions, the Customer must leave the establishment's room before the time indicated by the establishment, generally 12.00 p.m. on the day of the end of the reservation. Failing this, he will be charged an additional night.

6. CUSTOMER COMMITMENTS AND RESPONSIBILITY

The Customer is solely responsible for his choice of Services on the Site and their suitability for his needs, so that the responsibility of  Place Voltaire Getaway  cannot be sought in this respect.

The customer is responsible for what he communicates on the site and L'Escapade Place Voltaire cannot be held responsible in the event of erroneous or fraudulent information communicated by the Customer. In addition, only the Customer is responsible for the use of his account and for any reservation made, both in his personal name and on behalf of third parties, including minors, except to demonstrate fraudulent use resulting from no fault. , or negligence on his part. In this regard, L'Escapade Place Voltaire  must be immediately notified of any misappropriation or fraudulent use of their e-mail address to customer service, the contact details of which are specified in article 9.


The Customer undertakes to use the Site and the Services offered therein in compliance with the applicable regulations and these General Conditions. In the event of the Customer's failure to fulfill his obligations under these General Conditions, the latter is liable for the damage caused by him to L'Escapade Place Voltaire.  or to third parties. As such, the Customer undertakes to indemnify L'Escapade Place Voltaire against all claims, actions or recourse of any kind that may result therefrom and to indemnify it for any damages, costs or indemnities relating thereto.


The Customer, in particular, undertakes by making a definitive reservation for a Service, to pay the price and to comply with the Special Conditions relating thereto. In effect :

 

– Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the reservation of the Service at the Customer's expense, without prejudice to any action L'Escapade Place Voltaire could bring against of the last ;

 

– Any behavior contrary to morality and public order within the Establishment as well as non-compliance with the Establishment's Internal Regulations, will cause the Director of the Establishment and/or any other Service provider to request the Customer to leave the premises without any compensation and/or without any refund if payment has already been made. In the event that no payment has yet been made, the Customer must pay the price of the Services consumed before leaving the premises;

 

– The Customer also undertakes that the computer resources made available to him by the Establishment (in particular the WiFi network) will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required. The Customer is also required to comply with the security policy of the Internet access provider of the Establishment, including the rules for the use of the security means implemented in order to prevent the illicit use of the resources computers and to refrain from any act that undermines the effectiveness of these means.

 

7. COMMITMENTS AND RESPONSIBILITY OF ESCAPADE PLACE VOLTAIRE

 

The Escapade Place Voltaire undertakes, within the framework of an obligation of means, to provide access to the Site and to the Services offered in accordance with the General Conditions and to act with diligence and competence and to do everything possible, within a limit reasonable, in order to remedy any malfunction brought to its attention.

 

However, Escapade Place Voltaire may find itself obliged to temporarily suspend the Site without notice, in particular for technical maintenance reasons, without this entailing its liability.

The Customer acknowledges and accepts that L'Escapade Place Voltaire cannot be held liable for any inconvenience or damage related to the use of the Internet network, including, without this list being exhaustive:

 

– the incorrect transmission and/or reception of any data and/or information on the Internet;

 

– failure of any reception equipment or communication lines;

 

– any malfunction of the Internet network preventing the proper functioning of the Site and/or the reservation of the Services.

The Site may refer to hypertext links to other websites published and managed by third parties for which L'Escapade Place Voltaire  assumes no responsibility for the content of these websites and the services offered there. In this respect, it is specified that the partners are responsible for the promotion of the offers disseminated on their own websites. The decision to consult third-party websites is therefore the full and entire responsibility of the Customer.

The Customer acknowledges and accepts that in the event of a dispute and/or complaint relating to a stay in an Establishment or the reservation of a Service of L'Escapade Place Voltaire  the latter undertakes to contact exclusively the operating company of the Establishment concerned and that, as such, the Customer cannot in any way seek the responsibility of L'Escapade Place Voltaire  for shortcomings attributable to the Establishment.

8. FORCE MAJEURE

Neither party can be held liable to the other party in the event of non-performance of its obligations resulting from a case of force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party bears the cost of the resulting costs. The cases usually recognized by the case law of the Court of Cassation are considered as cases of force majeure. If the case of force majeure were to last more than thirty (30) days from its occurrence, these General Conditions may be terminated by any of the parties without any of them being able to claim award of damages.


 

In the event of force majeure or another exceptional event which prevents the performance of the Service and in particular making the room of the Establishment reserved available to the Customer, the Establishment may reserve the possibility of having the Customer accommodated, in whole or in part. in a room of equivalent category or perform a Service of the same nature, subject to the Client's prior agreement.

9. CUSTOMER SERVICE AND COMPLAINTS

For any complaint relating to a reservation of a Service on the Site, customer service is at your disposal.

10. PERSONAL DATA

Place Voltaire Getaway  implements the processing of personal data for which it is responsible.

The Customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers and information by the presence of an asterisk.

If information identified as mandatory is not provided, L'Escapade Place Voltaire  may not be able to register a reservation, manage the Customer's participation in the loyalty program and manage the latter's complaints.

For more information on the Customer's personal data processing policy, and in particular the purposes of the processing envisaged and the rights available to Customers, consult the Customer Personal Data Protection Charter accessible in the "Personal Data" section. in the lower banner of the Site.

By writing to escaleplacevoltaire@gmail.com, the Customer has the right to request access to his personal data, their rectification, their deletion, the limitation or opposition to processing, the portability of their data, as well as the possibility of give instructions on how this data should be treated after his death. The Customer also has the right to lodge a complaint with a supervisory authority.

The personal data of Customers will be kept in accordance with the legislation in force and the applicable limitation periods.

The Escapade Place Voltaire may send Customers a newsletter (newsletter), promotional offers, a satisfaction questionnaire following their stay by e-mail by providing the Customer with an unsubscribe link at the bottom of each commercial prospecting e-mail.

Some Establishments implement personal data processing for the purposes of prevention and security of property and people and the fight against unpaid bills.
 

11. MISCELLANEOUS

The entry of the required banking information as well as the acceptance of these General Conditions and the Special Conditions by electronic means constitutes an electronic contract between the parties which is worth proof between the parties of the reservation of the Service and the exigibility of the sums due in execution. of said reservation.

The applicable General Conditions and Special Conditions express the entirety of the obligations of the parties. No other condition communicated by the Customer may be included.

In case of contradiction between the Special Conditions and the General Conditions, the Special Conditions will be the only ones applicable for the obligation in question. In case of contradiction between on the one hand, the general conditions, of any nature whatsoever, of a partner and on the other hand, these General Conditions, the stipulations of these will be the only ones applicable for the obligation in question. .

If one or more stipulations of the General Conditions are held to be invalid or declared as such in application of a law, a regulation or following a decision passed into force of res judicata by a competent jurisdiction, the other stipulations will retain all their force and scope.

The authentic language is French. If the General Conditions were to be translated into a foreign language, the French language will prevail over any other translation in the event of a dispute, dispute, difficulty in interpreting or executing these conditions and more generally concerning the relationship between the parties.

The Customer acknowledges and accepts that L'Escapade Place Voltaire may assign these General Terms and Conditions, as well as all the rights and obligations attached thereto, to any third party, without the prior written consent of the Customer. The Customer accepts that such an assignment releases L'Escapade Place Voltaire for the future. The Customer may not assign the General Conditions, nor the rights and obligations attached thereto to third parties without the prior written consent of L'Escapade Place Voltaire.

 

 

12. APPLICABLE LAW AND DISPUTE RESOLUTION
 

The General Conditions are governed by French law, without obstructing any mandatory protective provisions that may be applicable in the consumer's country of residence.
 

The Customer is informed by L'Escapade Place Voltaire of the possibility of having recourse, in the event of a dispute relating to these General Conditions, to a conventional mediation procedure or to any other alternative method of dispute resolution, under the conditions provided for in Title I. of Book VI of the Consumer Code.

After contacting customer service or the Establishment to attempt to resolve the dispute amicably, and in the event of a negative response or no response within sixty (60) days of the referral, the Customer can contact the Tourism and Travel Mediator – BP 80303 – 75823 Paris Cedex 17.

 

• Referral to the Mediator can be done within twelve (12) months after the first complaint.

  13. SPECIFIC CONDITIONS OF SALE  

  13.2 cancellation/modification for individuals

Flexible rates can be canceled/modified free of charge up to D-6. After this period, the cancellation/modification fees will be 100% of the amount of the reservation.

  13.3 Towels and Linen

Each room has its own bed and bathroom linen.


 

  13.4 Check-in/Check-out 

Arrival time: 3:00 p.m., Departure time:  10:00 a.m.

  13.5 Age restriction

For security reasons, an age restriction of + 16 years may apply for unaccompanied minors. All minors must be accompanied and are under the responsibility of the accompanying adult(s).
